These terms and conditions are the standard terms which apply to provision of Fitness Classes and Services by South West Bro Workout Ltd, a limited company registered in England under [Company no 13990489]. Our registered address is [109 Gaskell Street, London, England, SW4 6PB], United Kingdom. (“Us”); and where the customer is a “Consumer” as defined by the Consumer Rights Act 2015.

Definitions and Interpretation In these Terms and Conditions, unless the context otherwise requires, the following expressions have the following meanings:

“Business” means any business, trade, craft, or profession carried on by You or any other person/organisation;

“Consumer” means a “consumer” as defined by the Consumer Rights Act 2015, and in relation to these Terms and Conditions means an individual who receives or uses services from Us consisting of one or more Fitness Classes for the individual’s personal use and for purposes wholly or mainly outside the purposes of any Business;

“Data Protection Legislation” means the Data Protection Act 1998 and the General Data Protection Regulation (GDPR) (Regulation (EU) 2016/679) as amended or replaced from time to time;

“Fitness Class” means any group session at which We provide either in-person or remotely via Zoom or lead any physical exercise class, including any teaching, instruction or training and all facilities, services, equipment, and other goods and materials which we provide/use in connection with these Fitness classes

“Our premises” means the premises at which We hold Fitness Classes as detailed on our website and which may change from time to time;

“Price List” means Our standard price list for all Fitness Classes which We offer. The details of our Fitness Classes and their prices are available from [website].

“Fitness Classes Form” means the registration form that We send to You for You to complete when you first sign up to the Fitness classes.

Joining Our Fitness Classes

Whether You want to book a free trial class or sign up for Fitness Classes, then You must email to bookings@swbw.co.uk. You can always book a Fitness Classes online. If You want to sign up regularly, then We will need personal details from you such as your medical history. You will be required to complete a Fitness Classes Form, which will be supplied to You as a link and You will be asked to complete and submit it online. By completing the form you will be agreeing to these Terms and Conditions and there will be a contract between You and Us based on these Terms and Conditions.

Booking of classes

You must be over 16 and a ‘consumer’ to book and attend any Fitness Class. You may book one free trial class of any type. Minimum booking: A minimum of 4 weeks within any one ‘term’ must be booked and paid for. A ‘term’ or ‘course’ refers to roughly a 6 or 12 week period of time, the exact dates of which will be found on the website swbw.co.uk, and are determined by South West Bro Workout Ltd. Booking one-off classes or periods shorter than 4 weeks is not permitted. If you are a new customer to South West Bro Workout Ltd and you join our Fitness Classes just before the end of a term, you may book the remaining weeks of the term pro-rata.

Missed sessions

In the event of a sustained illness or injury that prevents you from attending sessions, please contact us at bookings@swbw.co.uk as soon as possible. We understand that certain circumstances may arise, and we will handle each case individually. If you qualify, you may be able to freeze your payment until you have recovered.

However, please note that once sessions are purchased, cancellations made by consumers will not be eligible for refunds. We value your understanding that rolling over sessions due to illnesses such as colds, flu, Covid, etc. is not permitted. We encourage you to consider your commitment to attending sessions before making a purchase.

Cancellation / rescheduling

We reserve the right to cancel or reschedule a Fitness Class at any time before the advertised time and date of that class in the following circumstances:

  • The required instructor necessary for the Fitness Class is unavailable.
  • There is a problem with the venue, wifi, or any event beyond our control.

We also reserve the right to expel you from any Fitness Class if your conduct is deemed unacceptable or harmful to our reputation, or if it constitutes a breach of our Terms and Conditions. In such cases, you will not be entitled to a refund for a Fitness Class that has started but not been completed due to expulsion. If we cancel the remaining period of your purchased Fitness Classes package, we will refund you for the remainder of the cancelled package (rounded down to the nearest week).

Fees and Payment

Please refer to our Price List for payment details and current pricing information on our website.

You can choose from three class booking types:

  1. One class per week.
  2. Unlimited classes per week.
  3. School seasonal classes (Half-term or full-term)

How and when to pay Towards the end of a term, all members will be notified about the start of a new term, including the dates, cost, and when payment should be received, through our termly renewal of classes email. Payments for a term’s fees must be paid in full at the beginning of the new term. If you need to pay in two parts, it may be possible upon request. Please send a request to bookings@swbw.co.uk. However, if you have taken advantage of a special promotional deal, the full price as detailed in that promotion must be paid in one lump sum.

Payment should be made by online bank transfer only, and the details will be provided at the time of booking and are available on our website.

Fitness, Health, and Safety

By participating in our Fitness Classes, you acknowledge the physically strenuous nature of the sessions and voluntarily choose to participate with full knowledge of the inherent risk of personal injury or illness, even if we and the relevant instructor are not negligent.

Please note that certain Fitness Classes may be unsuitable for individuals with special needs, medical conditions, or fitness problems. It is your responsibility to ensure that you are fit and well enough to participate in any Fitness Class you attend. You should consult with a relevant medical or other advisor for appropriate advice regarding your fitness or health concerns before attending a Fitness Class, as we do not provide such advice.

When you register and attend any Fitness Class, it confirms that you have no health or fitness problems that may affect your participation. If you have any medical conditions, are taking medication that may impact your ability to participate, have circumstances affecting your health worsened by activities in a Fitness Class, or if you are pregnant (especially in the first 3 months), you must inform us in advance.

Failure to disclose relevant information about your health or fitness issues may result in us not providing some or all of the Fitness Class or other Fitness Classes. We may also cancel any remaining weeks in your termly package and refund you for each full week of Fitness Classes remaining.

Please refrain from attending any Fitness Class under the influence of alcohol or illegal drugs. It is recommended to arrive at least 5 minutes prior to the start time of a Fitness Class to ensure you are ready for the warm-up.

At South West Bro Workout Ltd, operating in London, UK, we prioritize the safety of our clients. Therefore, it is important to use the equipment and facilities provided by us in the correct manner. Please ensure that you do not use them in any way that may pose a health and safety risk to yourself or others.

Rules:

  1. Smoking is strictly prohibited anywhere on our premises.
  2. Bringing children under the age of 10 to our premises without prior agreement with the instructor is not permitted. We do not have anyone available to supervise them. If you bring a child under the age of 16, they will remain your sole responsibility during the Fitness Class, and they may not be permitted in the same room due to health and safety reasons.
  3. With the exception of guide dogs, animals are not allowed on our premises or the premises of which our facility is a part. If you require the use of a guide dog, please inform us during the registration process.
  4. Bringing crockery, glass, drinks (except water), or food into any part of our premises is not allowed. Only water, in plastic or metal bottles, is permitted.
  5. It is essential to be dressed appropriately for exercise, wearing well-fitting trainers suitable for the Fitness Class you are attending. Please remove loosely swinging or sharp jewelry before participating. Failure to comply with these dress requirements may result in your participation being denied.
  6. Familiarize yourself with and follow any instructions or information provided by us regarding fire or other emergency situations, as well as other health or safety issues.

If you are experiencing symptoms of Covid-19 and have previously attended any in-person classes, please inform us immediately. For the safety of everyone involved, you must not attend any in-person classes if you have tested positive for Covid-19 or any other variants associated with Covid-19.

At South West Bro Workout Ltd, we prioritize the safety of our clients during in-person fitness sessions and enforce the 2m social distancing rule to ensure the well-being of all participants. In the event of a local or national lockdown, where all in-person classes must cease, we will continue to offer these classes as zoom training sessions. The appropriate links will be provided to you. Please note that no refunds will be offered within a term as Fitness Classes can still be conducted remotely via zoom.

Events beyond our reasonable control

We cannot be held liable for any failure or delay in performing our obligations under the contract if it is caused by circumstances beyond our reasonable control. If such an event occurs that is likely to adversely affect our performance, we will inform you as soon as reasonably possible. Our obligations will be suspended, and any time limits will be extended accordingly.

Limitation of Liability

We will be responsible for any foreseeable loss or damage you may suffer as a result of our breach of these Terms and Conditions or due to our negligence. Loss or damage is foreseeable if it is an obvious consequence of our breach or negligence or if it is contemplated by you and us at the time our contract is created. However, we will not be responsible for any loss or damage that is not foreseeable.

Please note that the Fitness Classes we provide or sell are intended for your personal and private use only. We will not be liable to you for any loss of profit, loss of business, interruption to business, or any loss of business opportunity.

Our instructors are appropriately qualified for conducting their respective Fitness Classes. However, their advice does not include any medical or similar advice and should not replace advice provided by a qualified medical professional.

If you bring any personal belongings onto our premises, please be aware that we do not undertake to keep them safe or provide storage. Any loss or damage to your personal belongings will be at your own risk, except when such loss or damage is due to a deliberate or negligent act by us or our staff. We will not be responsible for any loss or damage caused by other customers, guests, or visitors to our premises. We advise you not to bring any valuable belongings to our premises.

Nothing in these Terms and Conditions is intended to exclude or limit our liability for death or personal injury caused by our negligence, including that of our employees, agents, or subcontractors, or for fraud or fraudulent misrepresentation.

If you are a “consumer” as defined by the Consumer Rights Act 2015 or any other consumer protection legislation, please note that nothing in these Terms and Conditions is intended to exclude, limit, prejudice, or otherwise affect any of our duties or obligations to you, your rights or remedies, or our liability to you under the relevant legislation. For more information about your legal rights, we recommend referring to your local Citizens’ Advice Bureau or Trading Standards Office.
